Accommodation contracts and related contracts entered into between the facility and guests shall be governed by these Terms; matters not provided for herein shall be governed by laws and regulations or by generally established customs. Notwithstanding the preceding paragraph, where the facility has agreed to a special arrangement that does not conflict with laws, regulations, or customs, that special arrangement shall take precedence.
A person who intends to apply to the facility for an accommodation contract shall provide the following: (1) Guest name (2) Date of stay and estimated time of arrival (3) Accommodation charge (in principle, the basic accommodation charge plus a 10% service charge) (4) Any other matters the facility deems necessary
The accommodation contract shall be concluded when the facility accepts the application set out in the preceding article. Upon conclusion of the accommodation contract, the guest shall pay, by the date designated by the facility, an application deposit determined by the facility up to the amount of the accommodation charge for the period of stay.
The facility may decline to conclude an accommodation contract in the following cases: (1) When there are no guest rooms available due to full occupancy. (2) When the person seeking to stay is found to be a member of an organized crime group (boryokudan), an organized crime group member, an enterprise or organization related to an organized crime group or a person related thereto, or any other antisocial force. (3) When the person seeking to stay has engaged in conduct that causes significant nuisance to other guests or to neighboring residents. (4) When violent demands are made in connection with the stay, or a burden beyond a reasonable scope is requested.
The guest may cancel the accommodation contract by notifying the facility. Where the guest cancels the accommodation contract for reasons attributable to the guest, the facility shall charge a cancellation penalty as follows: [Cancellation penalty (as a percentage of the accommodation charge)] No-show without notice: 100% Day of: 100% Up to 2 days before: 80% Up to 7 days before 50% Up to 14 days before: 30% Up to 20 days before: 10%
The hours during which a guest may use the guest rooms of the facility shall be from 3:00 p.m. (15:00) to 11:00 a.m. (11:00) the following morning. Notwithstanding the preceding paragraph, where the facility accommodates use of the rooms outside these hours, the following additional charges shall apply: (1) Up to 6 hours over: half of the room charge. (2) More than 6 hours over: the full room charge.
The facility may cancel the accommodation contract if the guest fails to comply with the house rules established by the facility. [Complete Non-Smoking Policy] The facility is entirely non-smoking throughout the premises (including all indoor and outdoor areas, terraces, parking lots, etc.). The use of any inhalation devices, including cigarettes, heated tobacco, and electronic cigarettes, is prohibited. [Penalties for Smoking] If smoking within the facility or the leaving of cigarette butts is discovered, the guest shall compensate for the following damages: (1) The actual cost of special cleaning of the guest room, deodorization work, and repair of fixtures. (2) Compensation for lost business for the period during which the room cannot be sold due to damage caused by smoking (such as residual odor) (100% of the selling price × the number of days). If smoking in the room is confirmed, the facility may immediately cancel the accommodation contract and order immediate departure. In such a case, no refund of the accommodation charge shall be made.
If damage occurs to articles, cash, or valuables deposited by the guest in the safe provided in the guest room, the facility shall compensate for such damage only where there is intent or negligence on the part of the facility. For items whose type and value were not declared in advance, the facility shall compensate up to 300,000 yen, except in cases of intent or gross negligence on the part of the facility. If the guest, through intent or negligence, damages, soils, or causes the loss of historic buildings, traditional crafts, furniture, fixtures, or the like, the facility shall claim reasonable compensation from the guest.
In accordance with Article 7 of the Accommodation Terms, guests are asked to observe the following rules.
(1) Please refrain from any act that may cause a fire in the guest room (such as the use of fire outside designated areas). (2) Accommodation by persons other than the registered guests is strictly prohibited. (3) Damaging acts such as affixing adhesive tape to, or driving nails into, the walls, pillars, fittings, etc. inside the building are prohibited.
(1) Please use the safe in the guest room to store cash, securities, and other valuables. (2) Lost property shall be kept for 7 days including the day of discovery, after which it will be handled in accordance with the Lost Property Act. However, food, beverages, and unsanitary items will be disposed of on the same day.
(1) Taking photographs or videos for commercial purposes within the facility without the facility's permission, or using such photographs or videos for commercial purposes (including posting on social media), is prohibited. (2) Photography that is contrary to public order and morals, that causes nuisance to other guests (or neighboring residents), or that involves inviting persons other than guests is prohibited. (3) If photography damages, or risks damaging, the image of the facility, the facility will request the cessation of photography, the deletion of posts, and compensation for any damage suffered by the facility.
(1) Bringing in pets such as animals or birds. (2) Bringing in items that emit a foul odor. (3) Loud singing, noise, gambling, or acts that disturb public morals in a manner that disturbs the neighborhood. (4) Bringing in food or beverages from outside without the facility's permission, and ordering takeout or delivery, etc. These Terms and Rules have been established to preserve the value and history of the "esoto" brand of Yamanashi Meijo Co., Ltd.
